If a daughter marries against her father’s will out of love or if she marries a man of a different religion, she will not get a share in her father’s property. If she marries outside the community or if the daughter behaves in a way that hurts the father, the father can exclude his daughter from the will of the property. The Supreme Court has given an important order by saying that it will not interfere in this.<\/p>\n

A bench of the Supreme Court headed by Justices Ashanuddin Amanullah and K. Vinod Chandran has overturned the judgment of the High Court and the trial court that Shaila Joseph should be given a share in the property of her father N.S. Sreedharan. The woman had married a young man of a different religion. Therefore, Sreedharan had kept his daughter away. He had not written a share for her in his will either.<\/p>\n

She had challenged this and filed a lawsuit seeking a share in her father’s property. The lower courts had expressed doubts about the will. It had ruled that Shaila should be given an equal share in her father’s property along with her 8 other brothers. However, the Supreme Court has set aside the lower court’s judgment. It has ruled that Shaila has no right to her father’s property as per the will.<\/p>\n

“This is a will written by her father voluntarily. There can be no interference in this. The judgment of the High Court and the trial court is set aside. Shaila has no right to her father’s property. All the property has been given to her other brothers through a will as per the will of her father,” the Supreme Court said.<\/p>\n

Gender equality is not relevant to this case. According to this, women also have equal rights in property. However, in this case, the will of the person who wrote the will is important. If he had not written a will, the daughter would have also had a share in the ancestral property. “However, since he deliberately wrote the will so that his daughter should not get the property and this is his last will, his decision is final.
